Official Sweepstakes Rules and Regulations by Tin Soldier Racecars

1. Introduction: This sweepstakes (the "Giveaway" or "Promotion") hosted by Tin Soldier Racecars ("The Sponsor") is designed to offer our loyal customers and enthusiasts a chance to win exceptional prizes. Participation in this sweepstakes is subject to the following official rules and regulations.

2. Eligibility: This sweepstakes is open exclusively to legal residents of the United States, who have reached the age of majority in their respective jurisdiction at the time of entry. Employees of Tin Soldier Racecars, its affiliates, and their immediate family members are not eligible. Notably, the purchase of apparel and merchandise from our website during the contest period does not constitute eligibility for those outside the designated geographic area or under the legal age. If a purchase is made by someone not meeting these criteria, they are still ineligible to win the contest, and in the event of their name being drawn, a redraw will occur.

3. Sweepstakes Period: The sweepstakes commences at 5:00 PM Eastern Standard Time (EST) on July 3rd, 2025, and concludes at 11:59 PM EST on September 1st, 2025.

4. How to Enter: Participants can enter the sweepstakes in the following ways:

Purchase Entries: During the promotion period, eligible entrants will receive one (1) entry for every $5.00 USD spent on eligible purchases of specially marked TSR apparel and merchandise made online at www.tinsoldierracecars.com
The range of apparel and merchandise eligible for this sweepstakes is clearly marked and available for viewing. There is no upper limit on the number of entries one can obtain via this method. *Purchases of merchandise and/or products in any other collection or category at www.TinSoldierRacecars.com will NOT earn entries into this giveaway. The number of entries you receive will be based on the list price of your eligible purchase (excludes discounts, sales tax, and shipping charges). If a purchase is returned prior to the drawing, entry/ies associated with that purchase will be voided. All purchases are subject to Sponsor’s return policy. Your purchase transaction must be received by 11:59:59 PM ET on September 1, 2025 to be eligible to receive entries. No limit on the number of entries received with a purchase. By entering via the Website, you consent to receive email communications from the Sponsor.
Alternate Free Method of Entry: In accordance with the laws governing sweepstakes, an alternate method of free entry is available. Details of this method are outlined in section 8 of these rules.

5. Prize Selection and Notification: The winner of the sweepstakes will be selected through a random drawing using the ViralSweep program. The selected winner will be contacted directly by an employee of Tin Soldier Racecars via the phone number provided at checkout, or by email if no phone number is available. You will NEVER be asked to provide a credit card, bank information or a payment of any kind as a condition of a prize award. Those are sure signs of sweepstakes scams. We do NOT use social media to contact winners of the giveaways we offer. The winner is required to respond by September 21st, 2025 (three weeks) to claim their prize.

6. Prizes:

Bischoff Racing Engines: A BES 427 motor is available as a prize.
Cash Option: Alternatively, the winner may opt for a cash prize of $2,500.
Tax Documentation: The winner will be issued a 1099 tax form for receiving either the prize package or the $2,500 cash option. All taxes associated with the receipt and/or use of the prize are the sole responsibility of the winner.

The prize will be awarded “AS IS” without warranty by Sponsor of any kind. Winner acknowledges that Sponsor has not made nor is in any manner responsible for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any component of the prize offered in this Giveaway, including but not limited to its quality, mechanical condition or fitness for a particular purpose.

7. General Terms and Conditions:

Sales Policy: All sales made during the sweepstakes period are final. There will be no refunds or exchanges permitted. Some orders may be delivered post-contest conclusion.
Shipping: Shipping costs for delivering the prize to any location within the eligible 48 states will be covered by Tin Soldier Racecars. However, the winner may choose to pick up the prize from our warehouse at their own expense.
Prize Conditions: Prizes are non-transferable, and no substitution will be permitted. Winners cannot sell or otherwise transfer their winnings. Prizes will be delivered only to the verified winner's name and address.

8. Alternate Free Method of Entry: For individuals who wish to participate in the sweepstakes without making a purchase, a free method of entry is available. To receive five (5) entries without making any kind of purchase, on a plain piece of 3”x5” paper, hand print your complete first and last name, street address, city, state/province/territory, zip/postal code, date of birth (mm/dd/yyyy), e-mail address plus daytime telephone number including area code. Mail your entry in a #10 business-size envelope with first-class postage affixed to: 2134 Petersburg Rd., Hebron, KY 41048. Your outer-mailing envelope must include a valid return address, which includes a complete first and last name. Mailed entries received without a verifiable and legible return address will be deemed incomplete and invalid. Limit one entry per outer-mailing envelope. Bulk shipments (multiple entries in one shipping package) will not be accepted. Mail-in entry, including outer-mailing envelope must be handwritten. No mechanically reproduced entries or metered mail permitted. Entries that are postmarked by September 1, 2025 and received by September 4, 2025 will be eligible for the drawing. Each mail-in entry will count as five (5) entries. There is a one household limit on the number of mail-in entries an entrant can submit.

Mail-in entries that are not in the format specified above, that are illegible, inaccurate, incomplete, or reproduced via photocopier or otherwise will be considered null and void. Proof of submission does not constitute proof of receipt. Not responsible for lost, late, illegible, mutilated, misdirected, postage-due entries or entries not received by the deadline. All material submitted becomes property of Sponsor and will not be returned. No correspondence will be acknowledged or entered into; requests for confirmation of receipt of mail-in entries will not be acknowledged.

9. Liability and Release: Tin Soldier Racecars shall not be liable for any loss, damage, injury, or any other claims or damages arising out of the participation in this sweepstakes or acceptance and use of the prize.

10. Privacy Policy: Participant information collected during the sweepstakes will be used in accordance with the privacy policy of Tin Soldier Racecars, which outlines the handling and usage of personal data.

11. Sweepstakes Governance: Tin Soldier Racecars reserves the right to modify, suspend, or terminate the Sweepstakes in the event it becomes infected by a computer virus, compromised technically in any way, or otherwise fails to run as planned, including but not limited to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Tin Soldier Racecars that corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes.

In the event of such an issue, Tin Soldier Racecars may, at its discretion, elect to hold a drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. Tin Soldier Racecars reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of the Official Rules of this or any other promotion or in an unsportsmanlike or disruptive manner.

In the case of dispute, decisions by Tin Soldier Racecars are final and binding. Any disputes relating to the Sweepstakes or these Official Rules shall be governed by the laws of the State of Kentucky, without regard to conflicts of law principles. All participants consent to the jurisdiction and venue of the state and federal courts located in Kentucky for any legal action arising from or related to this Sweepstakes.

12. Disqualification Rules: Participants may be disqualified for fraudulent behavior, multiple entries beyond the limit, or providing false information.

13. Governing Law and Dispute Resolution: Governed by the laws of Kentucky. Disputes will be resolved through arbitration.

14. Publicity Rights: Participants consent to the use of their names and images for promotional purposes without additional compensation.

15. Winner’s List: Information about the winner can be obtained by contacting 859-359-5068.

16. Amendments to the Rules: Tin Soldier Racecars reserves the right to amend these rules with no notice.

17. No Affiliation with Brands: Unless officially partnered, this sweepstakes is not affiliated with any brands mentioned.

18. Acknowledgment of Understanding: By participating, entrants acknowledge their understanding and agreement to these terms.

Void Where Prohibited: This Sweepstakes is void in any jurisdiction where it is prohibited or restricted by law. Participants are responsible for ensuring their eligibility in their respective jurisdiction. Tin Soldier Racecars reserves the right to restrict or prohibit participation from any jurisdiction at any time without prior notice.

Compliance with Laws: The "BES 427 Giveaway" is subject to all applicable federal, state, and local laws and regulations. By entering this Sweepstakes, participants agree to abide by these rules and acknowledge that the Sweepstakes is in no way unlawful in their jurisdiction. Tin Soldier Racecars disclaims any liability for any participant's failure to comply with any laws or regulations.

Disputes/Choice of Law: Any disputes arising out of or connected with this Sweepstakes, which are not resolved through arbitration, shall be resolved individually, without resort to any form of class action, and exclusively by the state or federal courts located in Kentucky. Participants waive any and all objections to jurisdiction and venue in these courts and hereby submit to the jurisdiction of those courts. This Sweepstakes is governed by the laws of Kentucky without regard to conflict of law principles.

It is important for participants to understand that this Sweepstakes is not in any way sponsored, endorsed, administered by, or associated with any third-party platforms that may be used for its promotion, including but not limited to ViralSweep.

Tin Soldier Racecars utilizes ViralSweep solely as a medium to facilitate and promote the Sweepstakes. The said platform is a service provider and is not responsible for any aspect of the Sweepstakes, including its administration, the collection of entries, or the selection of winners.

20. Participant Acknowledgment: By participating in the Sweepstakes, all entrants acknowledge and agree that their participation is in compliance with the terms and conditions of ViralSweep. Furthermore, participants agree to release ViralSweep from any and all liability associated with the Sweepstakes. Any questions, comments, or complaints regarding the Sweepstakes must be directed to Tin Soldier Racecars and not to ViralSweep.
